    Copyright protection in Nepal

    This thesis entitled "Copyright protection in Nepal" focus specifically on copyright protection. Copyright, a critical component of IPRs, safeguards the rights of creators over their literary, artistic, and other intellectual creations. Despite the enactment of laws such as the Copyright Act of 2002 and subsequent regulations, Nepal's copyright framework faces significant challenges in aligning with international standards and addressing emerging issues such as digital piracy, fair use limitations, and economic and moral rights post-author death. The study examined the current status of Copyright law in Nepal and the special provisions for libraries given by Copyright law of Nepal. A doctrinal research methodology was employed, relying on an extensive review of primary sources, such as legislation, as well as secondary sources like reports. Key findings reveal that Nepalese copyright laws lack provisions for modern challenges, such as digital content piracy and royalties for creators in broadcasting contexts. The mandatory registration of works under earlier laws contributed to low engagement by creators, while the current voluntary registration system under the Copyright Act of 2002 has not significantly improved compliance or awareness. Case studies underscore the limited scope of enforcement. This thesis concludes by proposing actionable recommendations to strengthen Nepal’s copyright framework. These include legislative amendments to address digital piracy, institutional reforms to enhance enforcement capacity, and public campaigns to increase awareness among creators and consumers.
